Whose fault would this be?

I live in ohio and live on a somewhat busy road. The speed limit is 45. One of my neighbors a few miles down the road was sitting at the end of his driveway on his lawnmower. Just as I was getting close he wasn't paying attention and started to go into the road to turn his mower around for whatever reason. I hit the break, but didn't swerve or anything just then he stopped and didn't go into the road. If my car and his lawnmower hit who would have been at fault. I am on a main road and he is coming out of a driveway without looking on a busy road... I was paying attention and going the speed limit. They live on a busy s-curve, so what he was doing is very dangerous. Who would have been cited if there was an accident???
